General

a) This document is an electronic record governed by the Information Technology Act, 2000.

b) It complies with the Information Technology (Intermediaries guidelines) Rules, 2011, and provides terms for somgiriveda.shop.

c) Definitions: "You" or "User" is the person accessing the Website; "We," "Us," and "Our" refer to the Website/Company; "Parties" refers to the User and the Company.

d) Section headings are for organizational purposes only.

e) By using the Website, the User agrees to be bound by these Terms and the Privacy Policy.

f) This forms a legally binding agreement.

g) The Company reserves the right to amend these Terms without prior notice. Continued use implies acceptance of changes.

Our Services

Somgiriveda is an online D2C platform offering Ayurvedic and Herbal products under the "somgiriveda." brand for various health concerns.

Eligibility

By using this Website, the User confirms they have the legal capacity and eligibility to enter into binding agreements under the Indian Contract Act, 1872. Ineligible individuals may not use the Website.

Term

These Terms are effective until the User stops using the Website or until all transactions are concluded. Certain sections (13, 14, 16, and 18) survive termination. Note that product sales are a strictly bilateral contract between you and somgiriveda.

Termination (Company's Right)

The Company has the unilateral right to terminate the User's access to the Service at any time, without prior notice or reason.

Facilities Provided by the Website

Somgiriveda provides a platform for Ayurvedic and Herbal products and relevant information. Users can create an account using third-party login (e.g., social media). Products are natural, and their color may vary due to seasonal factors.

By providing contact information, the User consents to receiving calls, emails, and SMS from the Company/affiliates. Users can opt-out of promotional communications by emailing hitlerdeveloper@gmail.com (may take 7 working days).

Termination (Repetition)

The Company can unilaterally terminate the User's access at any time. The User remains bound by the Terms until their stated expiry.

Fees and Payment

a) Payments can be made via CC Avenue, Net Banking, Credit/Debit Card, UPI, and digital wallets.

b) GST will be charged separately.

c) Ayurmedics India may withhold payment in cases of misuse or fraud.

The Company reserves the right to modify the fee policy, and Users will be notified of changes.

User’s Responsibilities and Obligations

i. Provide accurate and complete information. Inaccurate details may lead to account rejection/restriction.

ii. Comply with all Company instructions.

iii. Carefully select products and review descriptions. Placing an order is a commitment to purchase.

iv. Track orders via email link or 'My Account'.

v. Responsible for all applicable taxes and costs.

vi. Promptly pay for purchased goods.

vii. Do not make bulk purchases for resale or engage in illegal activities; this may lead to cancellation and account blocking.

viii. The Company can cancel orders for products listed with incorrect pricing due to errors.

ix. Indemnify the Company against losses arising from breach of terms, laws, or warranties.

x. Act in the Company's best interest.

xi. Unauthorized use of information or software from the Website is prohibited.

xii. Maintain confidentiality of account and password.

xiii. Responsible for all activities under the account.

xiv. Use the account for personal use only.

The User further covenants that they shall NOT:

i. Harass, threaten, defame, or violate the legal rights of others.

ii. Disrupt access to the Website.

iii. Impersonate any person or entity.

iv. Publish harmful, obscene, or racially objectionable information, or encourage unlawful activities.

v. Infringe intellectual property (copyright, patent, trademark).

vi. Upload or distribute files containing viruses or corrupted software.

vii. Download illegally distributed files.

viii. Test the vulnerability of the Website or breach security measures.

ix. Damage the Website or associated networks.

x. Collect data about other users.

xi. Use the Website for any unlawful or prohibited activity.

xii. Violate any code of conduct.

xiii. Violate any applicable law or regulation.

xiv. Violate any part of these Terms or the Policy.

xv. Threaten the unity, integrity, defense, security, or sovereignty of India.

xvi. Publish false or misleading information.

xvii. Trade in prohibited or restricted items.

xviii. Cause the Company to lose services of its providers.

xix. Advertise or sell products/services not displayed on the Website.

User Authorization: The User authorizes the Company to disclose information to law enforcement if required. The Company has the right to remove content that violates Terms/laws, but the User remains responsible for posted content.

Company’s Responsibilities, Obligations, and Terms

a) List items according to its policies, with legal authority to sell.

b) Maintain adequate stock.

c) Ship products together, but may ship separately to avoid delay, notifying the User each time.

d) Mention estimated shipment/delivery time. Not liable for delays due to force majeure (unforeseen events).

e) Accurately describe items to avoid misleading the User.

f) Deliver products via its logistics partner.

g) Advise users on proper product usage (e.g., shaking, storage, consumption time).

h) Potential customers are residents of India aged 5 years or above. Delivery charges for buyers outside India will differ.

i) Grants a limited license for personal use. Modification or download without written consent is prohibited.

Returns, Cancellations, and Refunds

Return Policy: Products can only be replaced, not returned. Users have 3 days from delivery to request a replacement.

Cancellation Policy: Users can cancel orders by logging into "My Account" and clicking the "Cancel" button.

Refund Policy: No refunds are offered. Products may be replaced if the wrong item was selected or if damage occurred during delivery.

Suspension of User Access and Activity

The Company can limit access/activity without notice for:

a) Breach of Terms/Policy.

b) Providing inaccurate information.

c) Actions that may cause harm to others or the Company.

d) Unauthorized copying of content.

Indemnity and Limitations

The User agrees to indemnify and hold harmless the Company against any claims, liabilities, or expenses arising from the User's actions, breach of this agreement, or violation of laws/rights. The Company/Website is not liable for any special, incidental, indirect, consequential, or punitive damages (e.g., loss of data or profits).

Intellectual Property Rights

All service marks, logos, and brand features are the property of the Company. No right to use these is granted without written consent. The Company retains exclusive ownership of Website designs/graphics. Reproduction or infringement may result in legal action.

Disclaimer of Warranties and Liabilities

a) All products/services are offered "as is" without any express or implied warranties.

b) The Company makes no warranties regarding information accuracy or completeness.

c) The Website may contain forward-looking statements with risks.

d) The Company does not guarantee uninterrupted or error-free functioning or that the server is free of viruses.

Submissions

Any contributions (feedback, ideas) made by the User grant the Company a royalty-free, perpetual, irreversible license to use and act upon such material. The User agrees to indemnify the Company against legal action related to submissions.

Dispute Resolution and Jurisdiction

Disputes will be resolved through a two-step ADR process: Mediation, followed by binding Arbitration under the Arbitration and Conciliation Act, 1996. The agreement is governed by Indian law, with jurisdiction agreed upon in Kurukshetra.

Notices

All communications regarding disputes/complaints must be sent in writing to the Company's registered office via RPAD or SPAD.

Miscellaneous Provisions

a) Entire Agreement: These Terms and the Policy constitute the final contract.

b) Waiver: Failure to enforce a provision does not waive the right to enforce it later.

c) Severability: If any provision is deemed illegal, the remaining provisions remain valid.
